Sublet agreements are legally binding if they comply with the basic rules of contract: there must be an offer, a joint exchange of promises, acceptance and the intention for both parties to be legally bound. They take effect as leases if exclusive possession over a space is granted and the term of occupation is determinable. However, a particular requirement of sublet agreements in many cases is that they require the permission of the landlord.
